{"id":37528,"date":"2026-04-15T16:29:56","date_gmt":"2026-04-15T22:29:56","guid":{"rendered":"https:\/\/thepueblatimes.mx\/?p=37528"},"modified":"2026-04-15T16:29:56","modified_gmt":"2026-04-15T22:29:56","slug":"congreso-poblano-acatara-fallo-de-la-scjn-sobre-ciberasedio","status":"publish","type":"post","link":"https:\/\/thepueblatimes.mx\/index.php\/2026\/04\/15\/congreso-poblano-acatara-fallo-de-la-scjn-sobre-ciberasedio\/","title":{"rendered":"Congreso poblano acatar\u00e1 fallo de la SCJN sobre ciberasedio"},"content":{"rendered":"<p>El diputado Pavel Gaspar Ram\u00edrez asegur\u00f3 que el Congreso de Puebla acatar\u00e1 la decisi\u00f3n de la Suprema Corte de Justicia de la Naci\u00f3n (SCJN), sobre ciberasedio.<\/p>\n<p>Ello, implica invalidar el Art\u00edculo 480 del C\u00f3digo Penal del Estado en materia de ciberasedio.<\/p>\n<p>En paralelo, anticip\u00f3 que impulsar\u00e1n una nueva figura jur\u00eddica para sancionar el ciberacoso con mayor rigor t\u00e9cnico, conforme a los criterios establecidos en la SCJN.<\/p>\n<p>Agreg\u00f3 que el acoso digital contin\u00faa como una problem\u00e1tica que afecta principalmente a ni\u00f1as, ni\u00f1os y adolescentes, al subrayar que el fallo de la Corte no niega su existencia, sino que se centra en la falta de precisi\u00f3n del tipo penal vigente.<\/p>\n<p>Expres\u00f3, \u201cquiero ser claro, el acoso digital es real y quienes lo sufren especialmente ni\u00f1as, ni\u00f1os y adolescentes merecen protecci\u00f3n efectiva (\u2026) el grupo parlamentario de Morena presentar\u00e1 ante el Congreso del Estado la iniciativa de abrogaci\u00f3n formal del art\u00edculo 480, cumpliendo con lo que nuestra Constituci\u00f3n exige\u201d.<\/p>\n<p>Pav\u00e9l Gaspar estableci\u00f3 lo anterior luego de que la SCJN declar\u00f3 la invalidez del Art\u00edculo 480 del C\u00f3digo Penal del Estado de Puebla, que tipificaba el delito de ciberasedio, al considerar que no cumple con los principios constitucionales de legalidad, taxatividad y m\u00ednima intervenci\u00f3n del derecho penal.<\/p>\n<p>En consecuencia, determin\u00f3 que la norma no define con suficiente claridad las conductas sancionadas, lo que podr\u00eda generar interpretaciones amplias en su aplicaci\u00f3n, por lo que no satisface los est\u00e1ndares constitucionales en materia penal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El diputado Pavel Gaspar Ram\u00edrez asegur\u00f3 que el Congreso de Puebla acatar\u00e1 la decisi\u00f3n de la Suprema Corte de Justicia de la Naci\u00f3n (SCJN), sobre ciberasedio.
